Legal update - Are you ready for the new laws on age?

October sees the introduction of the Employment Equality (Age) Regulations 2006 - the biggest change in employment law since the Sex Discrimination Act in so much as it affects every single employee and potential employee. In a nutshell, discrimination on the basis of age – whether that's 16 or 60 – will be illegal. And it's not to be taken lightly. In the US there was a 40% jump in employment tribunal claims when age discrimination legislation was introduced and in Ireland, age is now the basis of 19% of all employment cases. On the surface, the new law seems quite straightforward but there are a number of issues to consider in terms of recruitment, retention and training:

  • Ensure that graduate training schemes are open to all ages and not limited to those straight from university.
  • Just because you may have a young team, it does not mean that you can recruit the same sort of age “to fit in”.
  • Avoid the use of “mature” or “dynamic” in recruitment advertisements i.e. avoid using words that imply age.
  • Criteria for training should be age neutral and promotion should be based on skills and competency, rather than age or length of service.
  • Only ask for a date of birth on your monitoring form and ensure it is not seen by those involved in the selection process. Use skills/competence-based application forms which do not ask for any age related criteria.
  • Staff should not be promoted based solely on length of service.
  • Redundancy pay or redundancy selection criteria based on length of service is likely to be unlawful.
  • Medical cover should not have an upper age limit.

Should I stay or should I go?

According to our recent research, almost half of candidates who resign in the events, marketing and creative sectors, receive counter offers from their present employer to try and persuade them to stay. However, while it can be flattering to receive a counter offer, they often merely confuse an already stressful situation.

Regan & Dean offers the following food for thought for anyone considering a counter offer:

  • Never use a counter offer as a bargaining tool.
  • Moving roles isn't always about money – re-visit the reasons that caused you to seek a move in the first place – review your reasons in the light of what you are being told – are you really being offered anything new?
  • Consider that statistically, a high proportion of employees who accept a counter offer leave the company within six months to a year.
  • If you do decide to stay, ensure that any changes to your terms and conditions are confirmed in writing.
  • Think and talk all issues through thoroughly, with the people who know you best.
  • Be open with your recruitment consultant - they can offer sound advice and very importantly, keep everyone in the picture.
  • Remember that the right decision is the one that is best for you – and no-one else.

While any career move is obviously a positive, there are ways of making the most of your current role by knowing the best way to manage your boss! More on this in our next issue.

Building the brand that is YOU

We all know that the major corporate marketing departments understand the importance of brands and in today's competitive business world – particularly in the world of work - you have to be your own brand - and that means thinking of yourself not just as an employee but as a branded product:

  • Think about what makes you different and marketable – what are the qualities and characteristics that sets you apart from your colleagues and peers.
  • Devise a feature benefit list for the brand called ‘you'. For example – do you identify and solve problems before they become real issues? The benefit here to your employer would be that your employer gets less headaches – and probably saves money just by having you on the team.
  • Forget your job title – ask yourself how you add value – what can I be proud of and take real credit for – what have I achieved for this company?
  • In terms of marketing your brand – volunteer for extra projects that may give you visibility with other department heads – make yourself a sought after commodity.
  • When making yourself visible remember that everything you do matters – from the way you handle telephone conversations to the email messages you send to the way you conduct business in a meeting is part of the larger message you're sending about your brand.
  • The key to any personal branding campaign is "word-of-mouth marketing." Your network of friends and colleagues is the most important marketing vehicle you've got; what they say about the way you do things is what your target audience will ultimately gauge as the value of your brand.

The changing face of marketing

Anyone who has watched an episode of “Dragons Den” will know that as well as a great idea, it's marketing that can make or break a new product or service. Today's consumer is a sophisticated animal who will research options, plan ahead and make more informed decisions than ever before. That's why marketing has to be much more about engaging the consumer – getting them involved in the product has led to a whole new area of interactive and experiential branding. According to recent research by ID, an experiential marketing agency, 64% of consumers who had taken part in experiential marketing told someone else about it - it gives people a lot to talk about. And it's set to grow. We live in a world where consumers tend to screen out broadcast messages. Remember the scene in “Minority Report” where Tom Cruise walks into a Gap store to be welcomed by a screen character commenting on the fact that the trousers he had bought in blue last month were now available in brown? It's not that far off! The knock on effect of all this is that skill sets are evolving. Marketing, branding and advertising agencies now need traditional marketing skills combined with an appreciation of producing live events – and those that have that mix are hot property.
